Peconic Boat Rental LLC Terms and Conditions

Cancellation Policy:

  • Cancellations and changes can be made to any reservation free of charge up to 48 hours before the reservation period.
  • Cancellations made less than 48 hours before the reservation start time will not be refunded 
  • Weather
    • Peconic Boat Rental LLC reserves the right to cancel any reservation due to weather.
    • Peconic Boat Rental LLC will determine whether the weather conditions are safe and suitable for boating. 
    • The renter will be given a full refund of their reservation amount for single day rental cancellations.
    • Refunds are not given for unboatable days during a multiple-day reservation of 3 or more days.
  • Holidays
    • There are no cancellations or refunds given for bookings during “Holidays”
    • Holiday Periods
      • Memorial Day Weekend – Friday-Monday
      • 4th of July Weekend Thursday-Sunday
      • Labor Day Weekend Fri-Tuesday

Rental Policy:

Reserving a Boat

  • Total Expected rental fee (including New York State Sales Tax) holds a reservation for a boat rental with Peconic Water Sports. Fee can be paid on any major credit card or in cash. Please note, a valid credit card number and preauthorization is required for all boat rentals.
  • The renter must be experienced in the handling and operation of the vessel. If you do not feel comfortable with your abilities or experience, lessons are available. For those who do not have the required experience, we recommend going on a charter with one of our professional captains.
  • All renters must be at least 21 years old with a valid drivers license to rent a boat.
  • All reservations are contingent upon weather and the safe return of the rental boat by the previous renter. Peconic Boat Rental LLC reserves the right to cancel any reservation if the weather or equipment are deemed to be unsafe. A full refund will be provided for all cancellations made by Peconic Boat Rental LLC.

Operating Area

  • Boats must stay in the Peconic Bays, Greenport Harbor, Sag Harbor and Gardiners Bay. All operation in these bays must remain westward the line from Orient Point to Montauk Point and as far eastward as Robins Island. 
  • RENTAL BOATS ARE NOT PERMITTED IN SHINNECOCK BAY, SHINNECOCK CANAL, THE LONG ISLAND SOUND OR THE OCEAN.

Security Deposit

  • A $2500 security deposit is charged to and held against the renter’s credit card before any rental.
  • The renter is responsible for the first $2,500 of any damages that may occur, including propeller damage.
  • Gas and other expenses are charged to the renter’s credit card separate from the deposit
  • Rental boat use from dusk to dawn is not permitted. Should the renter choose to ignore this policy and damage occurs during the prohibited time period, the renter will be 100% liable for all damages.
  • By paying for this booking, the customer agrees to pay the above total amount according to the card issuer agreement.

Check Out/Check In

  • Rental boats leave and return per the times stated per the invoice above.
    • Rental periods can be extended to 7 pm for an additional $275
    • Rental boats returned after their stated end time will automatically be charged a late fee of $300
    • Rental boats returned after 7 pm without Staff approval will be charged an additional late fee of $300. Rental boats are not allowed to be on the water or operated at night
  • A signed contract (including the operators SS#) and photocopy of the drivers license must be on file prior to departure.
  • Renter must be present for the check in/check out procedure. A boat condition report checklist is completed with the renter prior to departure, as well as at the end of the rental period. In the absence of the renter, a signed Pick Up/Delivery disclaimer must be on file.
  • All persons boarding the vessel must sign the Peconic Boat Rental LLC “RELEASE OF LIABILITY, ASSUMPTION OF RISK, WAIVER OF CLAIMS, INDEMNIFICATION & BINDING ARBITRATION AGREEMENT” and will be provided means to do so by a Staff member. Anyone under 18 years of age must be signed for by a legal guardian. 
  • Off site docking and pulling up to waterfront restaurants is not allowed without prior approval from our staff. 
  • All boats heading to either Shelter Island or Sag Harbor Mill Creek Marina require a delivery fee of $150 and $200 respectively. 

Instruction/Lessons

  • Boat driving and safety instruction is available for those who do not qualify as “experienced boaters”. The instruction is provided at the beginning of the first day of your rental period. Lessons are billed at a rate of $125 per hour.
  • Boating instruction is not available at all times and must be booked ahead of time. We recommend you inform us at the time of your reservation if you need instruction.
  • 48 hour cancellation policy applies to boating lessons. Lessons cancelled less than 48 hours before the start time will still be billed the instructor’s full fee.
  • Lessons are not available during holidays

Authorized Operators 

  • Only those individuals listed as Authorized Operators will operate the Vessel; that Lessee will not exceed USCG Boat Capacity Plate with defined maximum passenger/load limits; that all lease fees are non-refundable once the stated lease duration has begun; and that in the event the Vessel is not returned at the specified time herein, said Lessee agrees to pay the $300 late fee;
  • The Lessor has provided safety and operational instructions, as well as, printed material (Boat Rental Orientation Checklist, Rental Policies, Local Navigational Charts) to Lessee and Authorized Operators explaining the applicable state and local boating rules and regulations, the operational characteristics, the environmental effects, and the common courtesies of operating a Vessel;
  • All Authorized Operators are capable in all aspects of the handling and operation of the Vessel and will operate in accordance with all safety rules and regulations, and further certifies that all Authorized Operators have read and understood said rules and regulations;
  • The Lessee and all Authorized Operators have been provided printed material (Rental Policies and New York Laws) and understand Lessor’s rules and agree to abide by them; and additionally that Lessor reserves the right to order any boat back to the dock for any violation of said rules with no refund;
  • New York State/Federal BWI & DWI laws apply. It is agreed and understood by the Lessee to indemnify and hold Lessor harmless of, from and against any and all loss, costs, damages, attorney fees and or liability in connection with any alcohol or narcotic related arrests resulting in the seizures of any Vessel owned or leased by Lessor;
  • LESSEE AGREES AND UNDERSTANDS THAT USE OF VESSEL IS PROHIBITED FROM DUSK TO DAWN. SHOULD THE RENTER CHOOSE TO IGNORE THIS POLICY AND DAMAGE OCCURS, SAID LESSEE WILL BE 100% LIABLE FOR ALL DAMAGES;
  • LESSEE AGREES TO REPORT ANY ACCIDENT, MALFUNCTION OR BREAKDOWN OF VESSEL TO LESSOR IMMEDIATELY IN ACCORDANCE WITH PARAGRAPH “o”;
  • The LESSEE(s) and Authorized Operator(s) am/are experienced and capable in all aspects of the handling and operation of the Vessel such as the one rented in this agreement;
  • And agrees that a Deposit (as defined in Damage Policy, attached hereto and incorporated within) shall be retained by the Lessor as partial compensation for failing to return said Vessel in as good condition, ordinary wear and tear excluded, as when received, for reimbursement of article damaged, missing or broken, or to be applied to the rental charges upon the return of the Vessel by Lessee;
  • He/she will not to use or permit the use: a) of the Vessel for any unlawful purpose; b) of the Vessel in a careless or neglectful manner; c) of the Vessel while under the influence of drugs or alcohol; d) by any other person that is not an Authorized Operator;
  • It is his/her responsibility for the safe and proper operation of the Vessel; and for the safety and welfare of other boaters and persons. It is AGREED AND UNDERSTOOD BY LESSEE that the LESSOR shall not be held liable for damages, inconvenience of time lost caused by accident, breakdown or malfunction of the Vessel. LESSEE FURTHER AGREES to indemnify and hold harmless the LESSOR from, and against any and all claims for loss of damage to property or injury to persons (including death) resulting from the use, operation or possession of said Vessel., including loss or damage caused by fire, water, theft, or any other cause whatsoever;
  • Lessee expressly agrees to indemnify and hold Lessor harmless of, from, and against any and all loss, costs, damages, attorney fees and/or liability in connection with enforcing of the Agreement by Lessor including expenses incurred in collection or attempting to collect delinquent rent and in the event of a suit by Lessor to recover possession of said rented property and /or to enforce any terms, conditions and/or provisions hereof. It is understood and agreed that Venue of any action hereunder shall be in the county of Lessor;
  • In the event of malfunctions, breakdown, or if any defect is discovered after acceptance of the Vessel, the Lessee will immediately report same to the Lessor. Continued use of Vessel shall be entirely at the Lessee’s risk and thus Lessee assumes all liabilities of injury and damage to all persons and property that may become involved by its continued use;
  • Lessor’s ability to provide a rental vessel, if reserved, is contingent upon and subject to the return of the rental vessel by the previous Lessee, or any cause beyond Lessor’s control; and
  • Should any terms and conditions of the Rental Agreement be held void or unenforceable, then that term shall be severed from this agreement and the enforceability of the remainder shall not be affected and will remain in full force and effect.

Renters Responsibilities

  • All rental boats are insured by Peconic Boat Rental LLC for liability and collision. However any damage done due to operators negligence or misuse will not be covered under Peconic Boat Rental LLCs insurance. Renters are responsible for the first $2000 of any damages or missing equipment.
    • Negligence or misuse includes ripped/torn upholstery, fiberglass damage, missing equipment, improper dockage, propeller/motor damage, etc…
  • The person who has signed the rental agreement is responsible for all damages to the rental boat, its contents and the actions of their passengers. NYS Boating law considers operating a vessel in excess of its capacity rating, gunwale and transom riding, wake jumping, operating above speed in a 5 mph zone, and operating too close to other vessels to be negligent operation.
  • Peconic Boat Rental LLC reserves the right to immediately terminate any boat rental reservation if negligent operation occurs. We take safety very seriously and we expect our customers to do the same.
  • All children under the age of 13 must wear a life vest at all times.
  • All State and Federal DWI and BWI laws apply on the water. It is agreed and understood by the renter to hold the LESSEE harmless of, from and against any and all loss, costs, damages, attorney fees and or liability in connection with any drug or alcohol related arrests resulting in the seizure of any boat owned by Peconic Boat Rental LLC or Peconic Water Sports LLC.
  • The renter must report any breakdown, accident, malfunction or incident of any kind involving the rental craft to Peconic Boat Rental LLC immediately.
  • Animals are only permitted on board with previous, written approval from Peconic Boat Rental LLC
  • Renters are permitted to dock the rental boat at a private location that has been approved prior to the rental period.
  • WATER SPORTS OF ANY KIND INCLUDING BUT NOT LIMITED TO TUBING, WAKEBOARDING, WATER SKIING, SLALOM SKIING, WAKESURFING; CANNOT BE CONDUCTED ON ANY RENTAL BOAT AT ANY TIME. VIOLATORS ARE SUBJECT TO FORFEITING THEIR ENTIRE SECURITY DEPOSIT.

Boat Club

  • All Boat Club members must abide to the rules listed within as well as review and sign the terms and conditions set forth in the Boat Club Membership Agreement. 
  • Members are privy to different usage hours, watersports rules, instruction, and equipment as stated on the Boat Club Membership Agreement. 
  • Deposits and Membership fees are non-refundable.

Damage Policy:

Structural Damage (Severe scratches, dents, fiberglass damage, fiberglass holes,

cracking, gel coat chips, etc.)…………………………………………Up to $2500

  • Propeller damage will be assessed and billed based upon the extent of the damage observed.
  • “Blade Reconditioning” is done when the propeller has minor damage, nicks, bends and small chunks missing can usually be reconditioned.
    • $150 plus tax
      • includes removal of damaged propeller, replacement with a spare unit, reconditioning, and replacement of propeller
  • “Blade Replacement” major damage requires the propeller be replaced. If reconditioning is not possible, the whole blade will be replaced.
    • $500 plus tax
      • includes removal and disposal of destroyed propeller and installation of new propeller
